Personally identifiable information (the “PII”): for non-residents of the European Economic Area, essentially includes, but is not limited to, information which can be used to identify, contact or locate You such as Your name, home and business address, email addresses, contact details and payment details.
Personally identifiable information (the “PII”): for residents of the European Economic Area, means any information relating to an identified or identifiable natural person. For the purpose of this definition, an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, and includes IP address and advertising ID (IDFA/AAID).
Non-personally identifiable information (the “NPII”): NPII includes, but is not limited to, Your IP address, cookies, third party’s cookies,web pages and ads that have been viewed by you on the Bonzai Platform, time spent on pages, and browser and device type. For non-residents of the European Economic Area, IP address and advertising IDs (IDFA/AAID) are NPII.
PII and NPII shall hereinafter be jointly referred to as the “Information”.
Information we collect
When You visit our web site located at https://bonzai.co, https://bonzai.ad or any sub-domains thereof or any of our applications (collectively, “Bonzai Platform”), You can choose to ‘Request Access’ and provide us with certain personally identifiable information about Yourself which may include your name, email address, home or business address, company’s name, telephone number, and debit or credit card information such as the credit card number, card verification value, or billing address. When You provide PII directly to us, this PII is used by the Company solely for the purposes identified at the time you provide the PII.
We do not collect this PII from you unless You elect to provide it to us.
We collect non-identifiable information such as the web pages which have been viewed by you on the Bonzai Platform and click-throughs. We also collect user lead information which will be stored in our system and are accessible to our customers.
OPT-OUT OF COOKIES
You can choose to remove cookies stored by us from your computer, or to prevent us from storing cookies on your computer in the first place. Bonzai cookies will appear in your browser as coming from one of the following domains: bonzai.co, bonzai.mobi, bonzai.ad. Most browsers are set to automatically accept cookies. However, most modern browsers can also be configured to decline cookies, and allow you to delete existing cookies. Consult your browser’s documentation, typically available through the “Help” menu on the toolbar, for instructions on how to prevent the browser from accepting new cookies, how to delete cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. If you choose to decline cookies, you may not be able to get some features offered by the Bonzai platform. Manner of usage
The Company may use Your PII, voluntarily submitted by You for purposes of, including but not limited to, identification, authentication, billing, and contacting You with notifications and/or product emails. Further, PII helps us create a more relevant experience for You with the Company. For example, we may use the Customer login name (PII) and connected browsing history (non-PII) to send better directed marketing emails.
We may use NPII when You interact with the Company services to better our studio product in terms of understanding the usage, such as the time spent viewing an ad, page views, video views, number of ads clicked and other information about your interaction with the ads, to better target ad messaging in our ads, show data in aggregate / segmented form for reporting, analytics for customers, third party services. We may use the information internally for any lawful purpose. Additionally, we may share this information with various third parties, including our publishers and advertiser partners. It is important to note that the PII is only provided to a publisher/advertiser when you affirmatively elect to provide such information to such parties.
In addition, the Company may use the Information provided by You or acquire such Information based on Your activities on the Bonzai Platform, in order to troubleshoot problems, enforce the Company’s Terms and Conditions and/or other related matters.
Otherwise stated above, we do not pass any user identifiable information to any third party.
Retention of information
Further, the Company will delete Your contact information and financial information from its active databases upon request made by You via email at firstname.lastname@example.org. Such information will be deleted as soon as reasonably possible in accordance with its policies and applicable law. However, the Company shall retain Your Information, which shall not be visible to other users or visitors, to be used in certain circumstances including, but not limited to, resolve disputes, troubleshoot problems, enforce the Company Terms and Conditions and as required by applicable law. Please note that some Information is never completely removed and/or deleted from the Company’s databases due to technical and legal constraints, including stored backup systems and archives. In the light of the above, it is not possible for Your Information to be completely removed and/or deleted from the Company’s databases in response to Your requests.
Bonzai is hosted by public cloud like Amazon, which is often certified for security. Bonzai has implemented commonly followed industry standards to protect against the unauthorized access to, retention of, and disclosure of information. Any information that is stored on our server is treated as confidential information. However, despite of best efforts, the security is often limited to the limitations and weakness of the state of the art Internet Technology.
The Bonzai Platform is not intended for children under the age of 13. Consistent with applicable laws, we will never knowingly collect PII from anyone under the age of 13 without requiring parental consent. Any person who provides their personal information to us through the Bonzai Platform represents that they are 13 years of age or older.
Notwithstanding the above, the Company in no way guarantees that such Information will not be accessed, disclosed, altered or destroyed by breach of firewalls and secured server software. The Company hereby disclaims any liability related to a security breach or loss of Your Information to the greatest extent permissible by law.
Our compliance with the EU General Data
Protection Act (“GDPR”) and Your rights under the GDPR
The Company is committed to its compliance with the GDPR when the enforcement begins on May 25, 2018. In case you are a resident of the European Economic Area, you have the following rights with respect to Your data for which Bonzai is the Data Controller (as defined in the GDPR):
You shall have the right to request access to, or ask us to provide You with copies of, the PII that we hold about You at any time; however such right may be subject to a fee specified by law for processing Your request (but not for making a request for access). In case Bonzai is the Data Controller with respect to Your data, we will respond to Your request within a reasonable period. If Bonzai is not the Data Processor with respect to Your data, we may redirect Your request to a Bonzai’s customer acting as the Data Controller with respect to Your data.
We may decline a request for access to PII in circumstances prescribed by the applicable privacy laws. If we decline a request, we will provide You with a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons) and provide You with a statement regarding the mechanisms available to you to make a complaint;
You have the right to ask us to delete any PII that we hold about you free of charge, unless we are required to maintain a copy of this data pursuant to applicable law;
You have the right to ask us to update and correct any out-of-date or incorrect or inaccurate PII that we hold about you free of charge. We will take reasonable steps to correct the information so that it is accurate, complete and up to date. If we refuse to correct your PII, we will provide you with a written notice that sets out the reasons for our refusal (unless it would be unreasonable to provide those reasons) and provide you with a statement regarding the mechanisms available to You to make a complaint;
You have the right to opt out of any marketing communications that we (or any third-party to whom we have disclosed your PII with Your consent) may send You or to withdraw Your prior consent or object to any further processing of your PII;
You have the right to request information about any automated decisions made using your PII that have legal consequences for You or which significantly affect You; and
You have the right to lodge a complaint with your local Data Protection Authority concerning Bonzai’s processing of your PII.
International visitors and customers
Please be informed that our servers are located in Singapore and Australia. In case You are located outside of Singapore or Australia, please be aware that any Information that You provide us, including PII, will be transferred from your country of origin to Singapore. Your decision to provide the Information to us, or to allowing us to collect such Information through the Bonzai Platform, constitutes your consent to transfer of Your Information to our servers. If you do not consent to the transfer Your Information, please do not submit Your PII to Bonzai. In case you would like Bonzai to access, correct, amend, delete, or export any of Your PII that You would have shared with Bonzai, please email email@example.com.
Updating Information and Deactivation Of Account
If Your Information changes or You wish to deactivate Your account, You may correct, update, amend, delete, remove or deactivate Your User account as well as withdraw Your consent by contacting the Company via email at firstname.lastname@example.org. The Company shall not be responsible for the authenticity of the Information provided by You.
